Welcome to Jalisco Alerta.
These Terms and Conditions of Use are designed to help you understand how you should use our mobile application, as well as the rights and responsibilities you assume when using our services. By accessing and using the Jalisco Alerta application, you expressly accept these terms.
General
These Terms and Conditions govern the use of the mobile application "Jalisco Alerta" (hereinafter "the Application") by its users, in accordance with the provisions of applicable Mexican legislation.
Identification of Parties and Involved Entities
The Owner: BONAFIDE MENS FIDELIS CO, SAPI DE CV, developer and owner of the Application's technology.
The Provider: The Government of the State of Jalisco, through the State Civil Protection and Firefighters Unit of Jalisco (UEPCBJ), is the official entity that provides and is responsible for the information and content of the alerts issued through the Application.
The User: Any person who uses the Application obtained through the official stores.
Service description
The Application is a free service that broadcasts alerts issued by The Provider, which may be generated from automatic monitoring systems and/or the evaluation of Civil Protection specialists. The service is limited to the dissemination of said information through notifications received by The User directly on their device.
For the effective receipt of notifications, The User must grant the necessary permissions on their device. The Application does not require or store the user's name, email, or telephone number.
Acceptance of service
The User, by downloading the Application and granting the requested permissions, implicitly accepts these Terms and Conditions, as well as the current Privacy Notice.
Terms of Use
COST OF THE SERVICE: The Application is offered free of charge. The Owner reserves the right to add future features subject to a cost.
GEOGRAPHICAL SCOPE OF THE ALERT SERVICE: The Application's alert and forecast system operates in the state of Jalisco, Mexico. The User can download and use the Application from any geographical location; however, the alerts and notifications issued by The Provider correspond exclusively to phenomena affecting the territory of Jalisco. The Application informs the User when their detected location is outside the state of Jalisco and automatically adjusts the notification settings accordingly.
PERMITTED USE: The Application is an informative consultation tool for personal use. It is prohibited to use it for purposes other than those established in these Terms and Conditions, including but not limited to: illegal activities, dissemination of misinformation, reverse engineering of the software, or unauthorized access to the systems.
Available languages
The application is available in Spanish, English, and French. The User can manually select their preferred language from the Application's settings, or the Application will adopt the language configured on the device when it is one of the supported languages.
Alert notifications and forecasts issued by The Provider are originally generated in Spanish. Translation into English and French is performed automatically using third-party translation services (Google Translate). The Owner does not guarantee the grammatical accuracy of the automatic translations. In case of discrepancy between versions, the Spanish version is the official and reference version.
Notifications
The Application operates via push notifications. For their correct receipt, it is essential that the User keeps notification permissions enabled on their device and has an internet connection.
The Application sends different types of notifications according to the classification defined by the Provider:
- Alerts: notifications about active disturbing phenomena (rain, flooding, hail, dust storm, among others), classified by severity (low, medium, high, and maximum). High and maximum severity alerts are sent as critical notifications that can activate sound and light signals on the device regardless of its silent mode settings, in accordance with the capabilities of the operating system.
- Advisories and forecasts: regionalized meteorological information for the 12 regions of the state.
- Informational and news: announcements from the Provider.
The User can configure a temporary pause on notifications from the Application settings. The Application automatically detects when the User leaves the state of Jalisco and notifies them about changes in the corresponding alert settings.
The correct functioning and receipt of notifications depend on external factors beyond the Owner's control, such as: the device's internet connection, the operating system's permission settings, the availability of third-party push notification services (Apple APNs, Google FCM), and the accuracy of the device's GPS signal.
Intellectual Property
The Owner reserves all intellectual property rights over the Application's technology, including, but not limited to: source code, logos, user interface, algorithms, and technical documentation.
The name "Jalisco Alerta" and the graphic elements associated with the Government of the State of Jalisco and the UEPCBJ are the property of their respective owners and are used in accordance with the current contract between The Owner and The Provider.
Liability and Limitation of Liability
The Application is an informational support tool and does not substitute official emergency protocols or instructions from the competent authorities.
The Provider (Government of Jalisco / UEPCBJ) is solely responsible for the accuracy, truthfulness, and timeliness of the content of the alerts issued.
The Owner (Erlia) is responsible for the availability and correct technical functioning of the software platform (with a 97% SLA), but not for the content of the alerts nor for the decisions that the User makes based on the information received.
The User must supplement the information received through the Application with other official communication channels and always follow the instructions of the competent Civil Protection authorities.

. Conflict Resolution
Any dispute or conflict arising in connection with the use of the Application shall be resolved in the first instance through the official user support channels (jalisco.alerta@erlia.mx). In the event of failing to reach an agreement, the parties shall submit to the competent laws and courts of Jalisco, in accordance with the provisions of Clause 14.
. Cancellation or Termination Policy
The uninstallation of the Application by the User is understood as the voluntary termination of the service. The Owner does not require any other action to terminate the contractual relationship.
The Owner reserves the right to suspend or cancel the access of any User who violates these Terms and Conditions, without any liability.
. Applicable law and jurisdiction
For the interpretation and fulfillment of these Terms and Conditions, the parties submit to the applicable laws of the United Mexican States and to the jurisdiction of the competent courts of the city of Guadalajara, Jalisco, Mexico, expressly waiving any other jurisdiction that may correspond to them by reason of their present or future domiciles or for any other reason.
. Modifications
These Terms may be modified by The Owner at any time. Updates will be published on the Application or official channels. Continued use of the Application implies acceptance of the new terms.
